1. Acceptance of Terms
By accessing or using the Vaidya247 mobile application, website, and related services operated by YESCA Technologies Pvt Ltd ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated by reference. If you do not agree, you may not use the Platform.
These Terms constitute a legally binding agreement between you and YESCA Technologies Pvt Ltd under the laws of India.
3. Platform Description
3.1 What Vaidya247 Provides
Vaidya247 is a healthcare workforce technology platform that offers two distinct services:

We provide matching, communication tools, verification workflows, payment facilitation (where applicable), ratings, and support — but we do not employ users, provide medical care, or guarantee any engagement outcome.
3.2 Facilitator Only — No Strings Attached
Critical — Read Carefully
- Facilitator, not employer: Vaidya247 is a technology facilitator only. We connect healthcare professionals and facilities. We do not employ, supervise, or direct clinical work.
- No strings attached: We impose no employment bond, no exclusivity requirement, and no continuing obligation on users beyond applicable platform fees shown at the time of use. Work terms, compensation, supervision, and outcomes are solely between the parties who connect on the Platform.
- Not a healthcare provider: We do not provide medical services, healthcare advice, or patient care.
- Not a staffing agency: We are not an agent, representative, staffing agency, or partner of any user.
- No employment guarantee: Applying to or posting a full-time role does not guarantee hiring, interview, or employment.
3.3 Terminology
Part-time opportunities are referred to as "gigs" to reflect their independent contractor nature. Full-time opportunities are listings on a job board. Neither creates an employment relationship with Vaidya247.
4. Profile Tiers and Access
4.1 Profile Tiers

4.2 Verification
- Full-time features are available at the minimal tier without full credential verification.
- Part-time locum features require verified tier — completion of onboarding with document upload and admin approval.
- We may suspend or restrict accounts that provide false information or violate these Terms.
4.3 Authentication
Account access is through phone number verification (OTP). You are responsible for securing your device and account.
5. Independent Contractor Relationships (Part-Time Gigs)
- All part-time (locum) gig engagements are independent contractor relationships between the healthcare professional and the healthcare facility.
- Vaidya247 is not a party to that relationship.
- When a doctor is booked, work terms (duties, schedule, compensation, supervision) are between those parties only.
- Vaidya247 provides no employment benefits (PF/EPF, ESI, gratuity, paid leave, or statutory employee benefits) for part-time gig engagements.
6. Full-Time Job Board
- Full-time job listings are a listing and application service only.
- Vaidya247 does not employ doctors, verify every listing claim, or guarantee any hire.
- Any employment relationship arising from a full-time listing is solely between the job poster and the applicant.
- Posting and applying to full-time jobs is free — no publishing or application fee.
- Each account may create a limited number of full-time listings per calendar month (IST). The current limit is shown in the app.
- Recruitment agencies (organization type recruiter) may post and manage full-time listings only — not part-time locum gigs.
- When you apply, you consent to sharing your profile snapshot with the job poster, including name, phone number, qualifications, and optional resume.
7. Part-Time (Locum) Gig Services
7.1 Eligibility
Only verified hospitals may post locum gigs. Only verified doctors may apply.
7.2 Platform Fees
Locum fees are configured dynamically and displayed before you pay. Fee categories include gig publishing fee (hospital), gig application fee (doctor), and platform commission on completed platform-paid gigs. Fees may be updated; applicable fees at the time of your transaction apply. Zero-fee promotions may temporarily offer ₹0 fees.
7.3 Payment Method (Locked at Creation)

7.4 Mutual Contact on Booked Gigs
After a locum gig is booked, the hospital and booked doctor may see each other's phone number on the gig detail screen for coordination.
7.5 Compensation
Under platform payment, the facility pays through Platform processing after completion. Under pay at location, compensation is paid directly between the parties. Vaidya247 is not responsible for non-payment or disputes on that path. All parties are responsible for their own tax obligations.
8. Cancellation and Refund Policy (Locum Gigs)
- Before booking: hospitals may cancel unpublished gigs per in-app rules; doctors may withdraw applications.
- After booking by facility: facility may forfeit publishing fee; doctor may receive application fee refund.
- After booking by doctor: doctor may forfeit application fee; facility may receive publishing fee refund.
- Gigs generally cannot be cancelled once work has commenced or after completion.
- Approved refunds are processed within 7–10 business days to the original payment method.
- Full-time listings and applications are free — no Platform fee refunds apply.
9. Advertising and Sponsored Content
The Platform may display sponsored advertisements. Ad content is the responsibility of the advertiser. We do not endorse advertised products or services. Ad interactions may be measured for delivery and billing (see Privacy Policy).
10. Eligibility and Indian Compliance
To use the Platform, you must:
- Be at least 18 years of age
- Be a resident of India or otherwise lawfully permitted to use the Platform in India
- Have legal capacity to enter into binding contracts
- Provide accurate registration information and maintain account security
10.1 Government-Employed Doctors
Important Notice for Government Doctors
Healthcare professionals employed by government organizations must ensure full compliance with applicable service rules before using the Platform. Vaidya247 does not monitor or enforce government service rules — users bear sole responsibility.
- You are prohibited from accepting duties during official government working hours.
- You must comply with central and state regulations regarding private practice, including no-private-practice rules where applicable.
- You must obtain required permissions from competent authorities where mandated.
- You accept full responsibility for disciplinary actions arising from breach of government service regulations.
10.2 Private Hospital-Employed Doctors
Important Notice for Privately Employed Doctors
Review your employment contract before accepting external duties. The Platform assumes you are legally permitted to work with multiple facilities unless your contract restricts you.
- Review exclusivity, non-compete, and external practice clauses in your employment agreement.
- Obtain written employer permission where required.
- By accepting gigs, you represent that you have authority to engage without violating primary employment terms.
- Vaidya247 is not liable for disputes between you and your primary employer.
11. User Conduct and Responsibilities
11.1 Prohibited Conduct
- Provide false or misleading information or credentials
- Impersonate any person or entity
- Post fraudulent, discriminatory, or unlawful listings or applications
- Harass, abuse, or harm other users
- Circumvent the Platform for fee avoidance on active locum engagements
- Interfere with Platform operation or use unauthorized automation
- Share account credentials
11.2 Healthcare Professional Responsibilities
- Maintain valid professional registration and licenses
- Provide competent care per applicable standards
- Maintain professional indemnity insurance (strongly recommended)
- Protect patient confidentiality and comply with medical ethics
11.3 Healthcare Facility Responsibilities
- Maintain valid facility licenses
- Provide accurate gig and job descriptions
- Verify credentials of engaged professionals
- Provide a safe working environment
- Honor confirmed locum bookings and act in good faith on full-time processes
12. Fees, Payments, and Taxes
- Payments are processed through Cashfree Payments (PCI-DSS compliant). We do not store complete card details.
- Platform fees for locum flows are charged at the time shown in-app.
- Users are responsible for GST, income tax, TDS, and other statutory obligations under Indian law.
- Transaction history and invoices/receipts are available in-app where applicable.
13. Intellectual Property
All Platform software, design, trademarks, and content created by Vaidya247 are owned by YESCA Technologies Pvt Ltd. Users retain ownership of their professional content but grant us a license to display profile and listing information for Platform operation.
14. Limitation of Liability
Maximum Extent Permitted by Indian Law
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Vaidya247 and YESCA Technologies Pvt Ltd are NOT liable for medical malpractice, facility safety incidents, employment disputes, hiring outcomes, credential fraud, payment disputes (including pay-at-location non-payment), or third-party service failures.
Maximum liability for Platform-related claims is limited to fees you paid to Vaidya247 in the 12 months before the claim, or ₹5,000, whichever is less.
15. Indemnification
You agree to indemnify and hold harmless Vaidya247 and YESCA Technologies Pvt Ltd from claims arising from your use of the Platform, your listings or applications, your professional services, your violation of these Terms, or your violation of applicable Indian law.
16. Privacy and Data Protection
Your personal data is processed per our Privacy Policy, compliant with the Digital Personal Data Protection Act, 2023 (DPDPA) and the Information Technology Act, 2000. By using the Platform, you consent to those practices.
17. Account Suspension and Termination
- You may stop using the Platform or request account closure via support. Outstanding booked gigs and payment obligations must be fulfilled.
- We may suspend, restrict, or terminate accounts for Terms violations, fraud, misconduct, repeated cancellations, false credentials, or regulatory requirements.
- Suspended users may be blocked from posting, applying, or transacting until admin review.
- Upon termination, access ends; legal retention periods apply per the Privacy Policy.
18. Dispute Resolution
18.1 Governing Law
Laws of India, including the Information Technology Act, 2000, Consumer Protection Act, 2019, Digital Personal Data Protection Act, 2023, and applicable healthcare regulations.
18.2 Jurisdiction
Courts at Hyderabad, Telangana, India have jurisdiction, subject to arbitration below.
18.3 Arbitration
Platform-related disputes (excluding medical malpractice) shall be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996, in Hyderabad, in English. Contact legal@vaidya247.com for informal resolution before arbitration.
19. Modifications to Terms
We may update these Terms. Material changes require in-app review and acceptance. We will notify you by email and/or in-app notice. Continued use after the effective date constitutes acceptance if you agree or if changes are non-material.
20. Acknowledgment
BY ACCESSING OR USING VAIDYA247, YOU ACKNOWLEDGE THAT:
- You have read and understood these Terms
- Vaidya247 is a facilitator only — not your employer, staffing agency, or healthcare provider
- There are no strings attached beyond applicable platform fees shown at the time of use
- Part-time gigs are independent contractor engagements between users
- Full-time listings do not create an employment relationship with Vaidya247
- Fees, payment methods, and refund rules for locum gigs are as displayed in-app
- You accept limitation of liability and indemnification provisions
- You consent to dispute resolution terms stated above
